Regardless of how the accident occurred, you may be entitled to a lump sum payment for your pain and suffering if your permanent whole person impairment is assessed as more than 10%. This payment is called a Permanent Impairment Benefit.
If the Accident was caused by the negligence of another person, and you have suffered a serious injury as defined by the Transport Accident Act, you will be entitled to sue the driver of the negligent vehicle in court for your pain and suffering. This sum could be up to $458,450.
